TRACEY HAYMAN

I am a Partner at Vizzone Ruggero Twigg Lawyers where I practise both as a senior family lawyer and as a mediator.

I hold National Accreditation as a Mediator (NMAS) and am specially trained to mediate all types of disputes, however I primarily mediate in the family law arena. I also hold a Masters Degree in Applied Family Law.

My personal nature is that I am a careful listener, a perceptive, caring, compassionate and considered person, which allows me to bring a unique understanding and empathy to mediations particularly those involving children’s and other sensitive issues.

Whilst my role as a mediator is impartial and I cannot provide parties with any legal advice in mediations, you can be completely confident that as well as the specialised  skills and training I have as a mediator, as a practising family lawyer, I also have knowledge, experience and insight in all aspects of family law, including parenting issues, relocation, child support, financial property settlements, inheritances, complex issues relating to trusts, corporate entities and self-managed super funds.

I also have extensive experience in and have appreciation for the delicacies and sensitive issues in matters where there is family violence, mental health issues, drug and alcohol issues, as well as specific experience in Child Protection matters, advising private clients in Children’s Court matters practise.

Facilitative
mediation

  • This type of mediation is my primary practice and most often takes place
when the parties are both legally represented, however, I also conduct
mediations for people who do not have a lawyer. You also do not need to
have Court proceedings on foot to participate in mediation.
  • Facilitative mediation is just that: I facilitate communication,
promote understanding and assist the parties to identify their needs and
interests, and uses creative problem-solving techniques to enable the
parties to reach their own agreement.
  • For legally represented parties: I will not give an opinion on what a
likely outcome for either property or parenting matters might be in the
Court, as you will have your own legal adviser with you at the
mediation. In some cases, if specifically asked for such opinion, I may
provide this, but a request for this must be provided at the time of
    booking the mediation.
  • For parties are not legally represented: If requested either prior to
booking or in the mediation itself, I am happy to provide an opinion as
to a range of likely outcomes if the matter does not settle at the
    mediation and proceeds to Court.
